The first thing to keep in mind is that bankruptcy does not mean that a company has closed its doors. There are several types of bankruptcy, and in some cases, companies declare bankruptcy so that they can renegotiate loans and obligations with creditors. During bankruptcy, past debts and obligations may be forgiven or waived, which frees the individual or company of the financial obligations. Bankruptcy stays on the credit record for seven years, during which time it may be difficult for individuals or companies to get loans or new lines of credit. It is precisely those two reasons which fuel the bankruptcy marketing industry, and make a bankruptcy mailing list a potential marketing tool for credit card companies, debt consolidators, attorneys and others.

How Lists are Made
Mailing lists are generally made through two methods: compiled and response. Bankruptcy marketing mailing lists are called compiled lists. This means that the information is gathered from public sources. Companies specializing in mailing lists comb through the public records and make a list from the information they find.
If you do not want to receive unsolicited mail, there is a national registry maintained by the Direct Marketing Association. Reputable mailers use this list and compare it via computer to compiled lists; any names that appear on both are suppressed, or kept off of the final mailing list. Note that companies are under no obligation to use this list maintained by the Direct Marketing Association, so putting your name on the list may suppress some, but not all unsolicited mail.

How Lists are Sold
Mailing lists are never sold outright even though most people speak about 'buying a mailing list.' Companies rent lists to other companies. When you pay for a mailing list, the company will ask you how many times you plan to use the list. The typical list rental license is either for one time use, meaning you can only send one mailing to the list, or multiple use. A multiple or unlimited rental agreement typically includes an expiration date. You can send multiple mailings out until the day the agreement expires, but not after.
What prevents a dishonest person or company from taking a mailing list and reselling it, or paying for one time use and then sending multiple mailings? List rental companies include names and addresses in the list called a seed file. A seed file is a file that the company creates that it includes in every mailing list it rents. The names and addresses on the seed file may be company employees, individuals, or specialized companies that do nothing but track mailing list usage. These companies and individuals provide samples of the mail they receive using the rented lists. The parent company that owns the list can file a lawsuit or seek reimbursement for anyone illegally using the list or using it more times than the contract states. Don't tempt fate by trying to pay for one time use and sending multiple copies. It's less expensive to pay the list rental fee up front than the legal costs or penalties incurred.
Email or Snail Mail Lists
Bankruptcy lists are generally used for snail mail, that is, for traditional postal mail. It's easier for list companies to obtain mailing addresses from public records than email addresses. Some companies may go the extra step of adding, or appending, email addresses to a postal address file. Expect to pay a lot more money for such files.
