Claudia, you need to talk to your accountant to answer this question. If someone is a full or part time employee, my understanding is that payroll taxes are due and are withdrawn as you stated. But to answer your specific questions, it would be smart to talk to a local accountant who understands your business. Good luck.

We were told that we MUST withdrawal taxes from our employees paychecks. However, a business in the same town, City Tavern, Culver, IN Larry Surrisi, In fact, does not. If this is leagal, I would like to do the same. If not, it is not fare to the other business struggling with keeping staff.

Taxes you are required to withhold from your employees and those you are directly required to pay makeup payroll taxes. These may include:

  • Federal
  • State
  • Local income taxes
  • Social Security and Medicare taxes
  • Federal and state unemployment taxes
  • Disability insurance taxes (in some states)
